Introduction

Sofrea LLC ("Sofrea," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us.

This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, and what rights and choices you have. It applies to your use of our website at https://sofrea.com (the "Site"), to purchases and subscriptions you make with us, and to our interactions with you by email, text message, or social media.

Sofrea LLC is the controller of the personal information collected through the Site. Our products are sold only in the United States, and the Site is intended for U.S. residents.

By using the Site, you accept the practices described in this Privacy Policy. If you do not agree with it, please do not use the Site.

1. Personal Information We Collect

We use the term "personal information" to mean information that identifies you or can reasonably be used to identify you.

1.1 Information you give us

  • Contact and account details — your name, email address, shipping address, billing address, phone number, and, if you create an account, your username and password.
  • Order and subscription details — the products you buy, order history, subscription plan and status, delivery preferences, and renewal, pause, and cancellation history.
  • Payment information — payment card details are collected and processed by our third-party payment processor. We do not store your full card number. We may retain limited details such as the card brand, the last four digits, and the billing address.
  • Customer service communications — the content of your emails, messages, and support requests, including anything you choose to include in them.
  • Marketing sign-ups — the email address you provide to receive our newsletter, to download our 30-day protocol, or to hear about launches and offers.
  • Reviews and user-generated content — any review, rating, photograph, video, or testimonial you submit, together with the name or initials you choose to display.
  • Quiz and survey responses — answers you give when you complete a quiz, survey, or assessment on the Site. Some of these answers may relate to your digestion, comfort, or wellness goals. See Section 10 and our separate Consumer Health Data Privacy Policy.
  • Promotions and collaborations — information you provide when you enter a giveaway, apply to our creator or affiliate program, or take part in a campaign.

1.2 Information we collect automatically

When you visit the Site or open our emails, we and our partners automatically collect:

  • your IP address, approximate location derived from it, device type, device identifiers, browser type, operating system, and language settings;
  • the page or advertisement that referred you, the pages you view, the links and buttons you click, products you view or add to your cart, how long you stay, and whether you complete a purchase;
  • whether you opened an email from us and which links you clicked.

We collect this through cookies, pixels, tags, web beacons, and server logs. See Section 4.

1.3 Information we receive from others

  • Our e-commerce and technology providers, including our website platform, payment processor, and fulfillment partners, which provide order, delivery, and fraud-screening information.
  • Advertising and analytics partners, which provide information about how our advertisements perform.
  • Social media platforms, if you interact with our accounts or click one of our ads — we may receive your public profile information and handle, subject to that platform's own privacy policy.

2. How We Use Personal Information

We use personal information to:

  • process, fulfill, and deliver your orders, and handle returns, refunds, and exchanges;
  • create and manage your account and any subscription, including recurring charges, renewal notices, pauses, and cancellations;
  • send transactional messages such as order confirmations, shipping notifications, and subscription notices;
  • provide customer support and respond to your questions;
  • send marketing emails to people who have signed up to receive them;
  • send reminders about items left in your cart;
  • collect, publish, and display reviews and user-generated content;
  • personalize the content, product recommendations, and offers you see, including based on quiz responses where you have consented;
  • measure, operate, and improve the Site, our products, and our marketing;
  • create and deliver advertising on social media and other platforms, and measure its performance;
  • detect, prevent, and investigate fraud, abuse, chargebacks, and security incidents;
  • comply with our legal obligations and enforce our Terms of Service.

3. Cookies and Similar Technologies

We use the following categories of cookies and similar technologies:

  • Strictly necessary — required for the Site to function: keeping items in your cart, securing checkout, and preventing fraud. These cannot be switched off.
  • Functional — remember your preferences.
  • Analytics and performance — help us understand how visitors use the Site so we can improve it.
  • Advertising and social media — used by us and our partners to show you relevant advertising and to measure its effectiveness. Under several U.S. state privacy laws, the use of these technologies may be treated as "selling" or "sharing" personal information, or as "targeted advertising." See Section 5.

Managing cookies. You can manage non-essential cookies at any time through the cookie preferences link on our Site. You can also block or delete cookies through your browser settings, though parts of the Site may not work correctly if you do. We recognize the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sale or sharing of your personal information where the law requires it.

4. How We Share Personal Information

We do not sell your personal information for money. We share it in the following ways:

  • Service providers. We share personal information with companies that perform services on our behalf: website and e-commerce hosting, payment processing, order fulfillment and shipping, email and text message delivery, subscription management, review collection and display, customer support tools, analytics, and advertising technology. They may use the information only to provide services to us.
  • Advertising and analytics partners. We share online identifiers and activity information with advertising platforms and analytics providers so we can reach people likely to be interested in our products and measure our campaigns.
  • Legal and safety. We may disclose personal information where we believe in good faith that it is necessary to comply with a law, regulation, subpoena, or government request; to enforce our Terms of Service; or to protect the rights, property, or safety of Sofrea, our customers, or the public.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction.
  • With your consent or at your direction.

We do not share consumer health data with advertising or analytics partners. We do not share your phone number with any third party for that party's own marketing purposes.

5. "Sale," "Sharing," and Targeted Advertising

Some U.S. state privacy laws define "sale" and "sharing" broadly enough to include the use of advertising and analytics cookies, even when no money changes hands. Based on our current practices, we share identifiers, internet activity information, commercial information, and inferences with advertising partners for cross-context behavioral advertising.

We do not sell or share the personal information of anyone we know to be under 16.

You can opt out at any time by:

  • using the "Do Not Sell or Share My Personal Information" link on our Site;
  • enabling a Global Privacy Control signal in your browser;
  • adjusting your ad preferences directly with the relevant platform; or
  • emailing us at privacy@sofrea.com.

6. Retention

We keep personal information only as long as we need it:

  • Order and transaction records — for as long as required by tax, accounting, and consumer-protection law, generally up to seven years.
  • Account and subscription information — while your account is active and for a reasonable period afterward.
  • Marketing contact details — until you unsubscribe, plus a limited period afterward to record and honor your opt-out.
  • Quiz and survey responses — no longer than two years, or until you ask us to delete them, whichever comes first.
  • Website and advertising analytics data — for the retention period set in each tool, typically no longer than fourteen months.

When information is no longer needed, we delete it or irreversibly anonymize it.

7. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights:

  • to know what personal information we collect, use, and disclose;
  • to access a copy of your personal information;
  • to correct inaccurate personal information;
  • to request deletion of your personal information, subject to exceptions;
  • to opt out of the sale or sharing of personal information and of targeted advertising;
  • to opt out of profiling that produces legal or similarly significant effects — we do not carry out this kind of profiling;
  • to limit the use and disclosure of sensitive personal information;
  • to obtain a portable copy of your personal information;
  • not to be discriminated against for exercising your rights.

How to exercise your rights. Email privacy@sofrea.com. Tell us which right you want to exercise and the email address associated with your orders.

Verification. To protect your information, we will take reasonable steps to verify your identity before acting on a request, usually by confirming details that match what we already hold. An authorized agent may submit a request on your behalf with valid written authorization.

Timing. We respond within the period required by applicable law, generally within 45 days. Where the law allows an extension, we will tell you before we take it.

Appeals. If we decline your request, you may appeal by replying to our response or writing to privacy@sofrea.com with "Appeal" in the subject line. We will tell you the outcome in writing and, if we deny the appeal, how to contact your state attorney general.

8. Notice for California Residents

In the past twelve months we have collected the following categories of personal information:

We do not use or disclose sensitive personal information for purposes other than those permitted without a right to limit under the CCPA.

Shine the Light. California residents may request information about our disclosure of personal information to third parties for those third parties' own direct marketing purposes by emailing privacy@sofrea.com.

9. Consumer Health Data

If you complete a quiz, survey, or assessment on the Site, or if you tell us about your digestion, comfort, or wellness in a message or review, that information may qualify as consumer health data under the laws of Washington, Nevada, and Connecticut.

We collect this information only with your consent, we use it to recommend products and personalize the content we send you, and we do not sell it or share it with advertising partners.

10. Marketing Emails

We send marketing emails only to people who have signed up to receive them. You can unsubscribe at any time using the link at the bottom of any marketing email, or by writing to support@sofrea.com.

We will still send you transactional messages relating to your orders, your subscription, and material changes to this policy. These are not marketing messages and you cannot unsubscribe from them while you have an active order or subscription.

We do not currently send marketing text messages. If we begin to do so, we will update this policy and will only send them to people who have separately and expressly opted in.

11. Third-Party Links

The Site may link to websites we do not control, including social media platforms and partner websites. We are not responsible for their content or their privacy practices, and this policy does not apply to them.

12. Where Your Information Is Processed

We and our service providers process and store personal information in the United States and, in some cases, in other countries where our providers operate. We require our providers to protect personal information in line with this policy.

13. How We Protect Personal Information

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access, disclosure, or alteration. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please avoid sending sensitive information to us by email.

14. Children

The Site is intended for adults. Our products are not intended for anyone under 18, and we do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, contact privacy@sofrea.com and we will delete it.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version here with a new "Last updated" date, and if the changes are material we will give more prominent notice, which may include emailing you.
